These Terms of Service constitute a legally binding agreement between you and the African College of Education & Technology ("ACET," "we," "us," or "our"). They govern your use of our website, applications, and educational services (collectively, the "Services").

If you are using our Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these terms.

Eligibility

By using our Services, you represent and warrant that:

Age Requirement

You are at least 18 years old, or if you are between 13 and 18, you have parental consent to use our Services.

Legal Capacity

You have the full power and authority to enter into this agreement.

No Prior Suspension

You have not been previously suspended or removed from our Services.

Compliance

Your use of our Services complies with all applicable laws and regulations.

International Students

If you are applying from outside Tanzania, you are responsible for complying with your local laws and obtaining any necessary visas or permits.

User Accounts

Registration

To access certain features of our Services, you must create an account. You agree to provide accurate, current, and complete information during the registration process.

Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use

One Account Per User

Each user may create only one account. Multiple accounts for the same individual may be subject to suspension.

Account Types

  • Student Accounts: For prospective and current students
  • Staff Accounts: For ACET faculty and administrative personnel
  • Partner Accounts: For institutional partners and collaborators

Fees and Payments

Tuition and Fees

All applicable fees, including tuition, registration fees, and other charges, are as described on our website and in your admission offer. By accepting an offer of admission, you agree to pay all associated fees.

Payment Methods

We accept the following payment methods:

  • Mobile Money: Tigo Pesa, Airtel Money, M-Pesa
  • Bank Transfer: Direct deposits to our bank accounts
  • Credit/Debit Cards: Visa, Mastercard (via secure payment gateway)
  • Bankers Cheque: Payable to ACET

Refund Policy

Refunds are governed by our Refund Policy, which is incorporated by reference:

  • Before Course Start: 90% refund up to 2 weeks before start date
  • Within First Week: 50% refund for withdrawal in first week
  • After First Week: No refund after the first week of classes

Late Payments

Failure to pay fees by the due date may result in late fees, suspension of services, or academic penalties including inability to register for courses or receive grades.

User Conduct

You agree not to engage in any of the following prohibited activities:

  • Illegal Activities: Violating any applicable laws or regulations
  • Academic Dishonesty: Cheating, plagiarism, or misrepresentation of work
  • Harassment: Harassing, threatening, or intimidating others
  • Impersonation: Impersonating another person or entity
  • Unauthorized Access: Attempting to bypass security measures
  • Spam: Sending unsolicited communications
  • Misinformation: Knowingly providing false information

Code of Conduct

All students are expected to adhere to the ACET Student Code of Conduct, which is available in the student handbook.

Consequences of Violations

Violations of these terms may result in:

  • Warning or notice
  • Temporary suspension of account
  • Permanent account termination
  • Academic penalties (for students)
  • Legal action

Academic Policies

Registration

By registering for a course or program, you agree to:

  • Complete all required coursework and assessments
  • Adhere to academic deadlines
  • Maintain satisfactory academic progress
  • Comply with examination rules and regulations

Attendance

Regular attendance is required for all programs. Excessive absences may result in:

  • Academic warning
  • Reduction in grades
  • Disqualification from courses
  • Withdrawal from the program

Grading and Assessment

Grades are determined according to the ACET Grading Policy. Disputes regarding grades must be submitted in writing within 30 days of grade posting.

Academic Integrity

All work submitted must be your own. Plagiarism, cheating, and other forms of academic dishonesty will result in:

  • Failure of the assignment or course
  • Academic probation
  • Permanent notation on academic record
  • Expulsion from the institution

Intellectual Property

ACET Content

All content provided through our Services, including but not limited to:

  • Course materials, lectures, and presentations
  • Website design, layout, and graphics
  • Software and applications
  • Logos, trademarks, and branding

is the exclusive property of ACET and is protected by Tanzanian and international intellectual property laws.

User Content

By submitting content (assignments, discussion posts, etc.), you grant ACET a worldwide, royalty-free license to use, reproduce, and display such content for educational purposes.

Student Work

ACET may retain exemplary student work for accreditation and promotional purposes, with student permission.

Attribution

You may not remove, alter, or obscure any copyright, trademark, or other proprietary notices appearing on our Services.

Limitation of Liability

To the maximum extent permitted by law, ACET and its affiliates, officers, employees, and agents shall not be liable for:

  • Indirect Damages: Any indirect, incidental, special, consequential, or punitive damages
  • Loss of Data: Any loss of data, opportunities, or profits
  • Service Interruption: Any interruption or cessation of services
  • Third-Party Conduct: Any conduct of third parties on our platform

Our total liability to you shall not exceed the amount you paid to us in the twelve months preceding the claim.

No Liability for Educational Outcomes

ACET does not guarantee specific educational outcomes, employment, or admission to other institutions.

Termination

Termination by You

You may terminate your account at any time by:

  • Contacting our support team
  • Using account deletion features (where available)

Termination by ACET

We may terminate or suspend your account immediately, without prior notice, for:

  • Violations of these terms
  • Fraudulent or illegal activities
  • Non-payment of fees
  • Academic dishonesty
  • Disruptive behavior

Effect of Termination

Upon termination:

  • Your right to access services ceases immediately
  • We may delete your account data
  • Outstanding fees remain payable
  • Academic records may be affected

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United Republic of Tanzania, without regard to its conflict of law provisions.

Dispute Resolution

Any disputes arising from these terms shall be resolved through:

  • Negotiation: First, through good-faith negotiations
  • Mediation: If negotiation fails, through mediation in Mbeya, Tanzania
  • Arbitration: Binding arbitration in accordance with Tanzanian arbitration laws

Venue

The exclusive jurisdiction for any legal action shall be the courts of Mbeya, Tanzania.

Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of material changes by:

  • Posting the updated terms on this page
  • Sending email notifications to registered users
  • Displaying a notice on our website

Your continued use of our Services after such modifications constitutes your acceptance of the updated terms.
